Terms of Service

These Terms of Service ("Terms") govern your use of ai-api.cloud ("we", "us", "the service"). By creating an account, using an API key or otherwise using the service, you accept these Terms. If you do not agree, do not use the service.
1. The service
ai-api.cloud is an LLM API gateway. It provides a single account, API key and prepaid balance to access large
language models through OpenAI-compatible (/v1/chat/completions) and Anthropic-compatible (/v1/messages)
endpoints. We authenticate your request, route it to the upstream provider you call, meter usage and return the
result. We do not alter, substitute or silently reroute your request; routing and errors are made visible.
The Service is a digital service provided solely by electronic means through an application programming interface (API). What you receive is access to processing your requests by language models and the resulting digital output; no tangible goods, media or physical products are supplied. The Service is considered rendered as and when it is actually used — per processed request.
2. Eligibility and account
- You must be at least 18 years old and able to enter into a binding contract.
- You are responsible for the accuracy of your account data and for all activity under your account and API keys.
- Keep your password, two-factor codes and API keys confidential. Treat an API key like a password — anyone holding it can spend your balance. You can rotate or disable keys at any time in your cabinet.
3. Acceptable use
You agree not to use the service to:
- break applicable law or infringe the rights of others;
- generate or distribute content prohibited by law or by the upstream provider serving your request;
- attempt to bypass authentication, rate limits, spending limits or billing;
- resell, share or abuse access in a way that disrupts the service or other users.
You are fully responsible for the prompts you send and the use you make of the responses. Upstream providers apply their own usage policies to the content you route through them.
4. Pricing and billing
- You top up a prepaid balance that may be used solely to pay for the Service. The balance is internal account credit for services — not a currency, electronic money or a deposit; it cannot be withdrawn as cash or transferred to third parties (except a refund under Section 5). US dollars are used only as a unit of account for pricing and metering. Payment is taken in the currency of the chosen payment system and converted into internal accounting units at our rate. There is no subscription — you pay only for actual usage.
- Each request is charged per token (input, output and cache, where applicable) at the price in effect at the moment the request is made. Your usage history shows the exact model, tokens and charge for every request.
- Before each upstream call we reserve an estimated amount from your balance and settle the actual charge afterwards.
- Prices, available models, model variants, providers and their capabilities may change at any time without prior notice. The price that applies to a request is the one in effect when the request runs.
- Discounts and special prices are temporary and apply only while shown in the current price list. They are a temporary bonus that may end or be exhausted at any time without notice and are not a permanent guarantee. You are responsible for checking current prices and discounts yourself; we do not notify you of changes.
5. Refunds and chargebacks
- What you pay for is access to the Service as a single offering — the ability to send requests to the set of models available at the time. There is no fixed or guaranteed list of models. The set of models, providers and their availability may change at any time; an individual model may be temporarily disabled, restricted or removed by us or by an upstream provider. This is normal operation of the Service and is not a ground for a refund — the service (access to models) is considered provided as long as other models remain available.
- A refund is possible only if: (a) the Service was not provided due to a proven technical fault on our side (the Service as a whole being unusable through our fault), or (b) you were charged but access was not actually provided. In such cases we refund the affected amount.
- Spent balance is not refundable. Unused prepaid balance may be refunded on request at the Administration's discretion, accounting for overhead and any non-refundable network or payment fees. Refunds are made only by the same method and to the same wallet/card/account the funds came from; if top-ups came from several sources, the refund is split in proportion to the amount topped up from each source. We do not refund by any other method (for example, to a different wallet/card or to cryptocurrency). Timing depends on the payment system and may take up to 14 days.
- If you believe you were charged in error, contact support first — we will investigate and correct genuine errors.
- You agree not to initiate a payment dispute or chargeback before contacting support. Initiating a chargeback without contacting us may result in suspension or termination of your account.
6. Disclaimer of warranties and limitation of liability
The Service and the underlying models are provided "AS IS" and "AS AVAILABLE", without warranties of any kind. We do not guarantee uninterrupted or error-free operation, the availability of any specific model or provider, or that any output will be accurate, complete or fit for a particular purpose. All decisions to rely on outputs are made by you, at your own risk.
To the maximum extent permitted by applicable law, we (the Service) are not liable for:
- any direct or indirect damages, including lost profits, loss of data or goodwill;
- any temporary or total unavailability of the Service, interruptions, delays, technical failures or access restrictions;
- the consequences of your use of any outputs (model responses);
- the acts or omissions of third parties, including upstream providers and payment systems.
The Service may be unavailable at any time — we are not liable for this.
Where applicable law does not allow liability to be fully excluded, our total liability for any claim is limited to the amount you paid us in the 30 days preceding the event giving rise to the claim.
7. Suspension and termination
We may suspend or terminate access if you breach these Terms, abuse the service, attempt fraud, initiate an unwarranted chargeback, or where required by law. You may stop using the service and request account deletion at any time. Where access is suspended for a violation, unused balance may be withheld pending resolution.
8. Intellectual property
The service, its software, design and brand are our property or that of our licensors. You may not copy, distribute or create derivative works of the service's materials without permission. As between you and us, you retain rights to the content you submit and to the outputs you receive, subject to the upstream provider's terms.
9. Privacy
Our handling of personal and usage data is described in the Privacy Policy, which forms part of these Terms.
10. Changes to these Terms
We may update these Terms. Material changes are reflected by the "Last updated" date above and, where appropriate, by asking you to accept the updated Terms. Continued use of the service after an update means you accept the updated Terms.
11. Support and contact
- If you have access to your account, contact support by opening a ticket inside the service (cabinet → Support). This is the primary support channel.
- If you have lost access to your account, write to support@ai-api.cloud.
- Support replies as workload allows, but no later than 48 hours.
